Ann Ryan and Adrienne Koch Publish New York Law Journal Article on Post-COVID Commercial Lease Casualty Provisions
Partners Ann E. Ryan and Adrienne B. Koch published the first in a series of three articles for the New York Law Journal on post-COVID changes to how commercial real estate leases are negotiated. The first article, which looks at casualty provisions, ran June 9.
In the article, Ryan and Koch examine how legal concepts of what constitutes a “casualty” shifted during the pandemic as both commercial landlords and tenants sought relief from losses due to lockdowns and other public measures. They suggest that both parties need to focus on striking a balance between the risks taken on by each side in order to negotiate workable lease agreements.
