Biography

After beginning his career in a large, multinational firm, Elan Dobbs came to Katsky Korins in 2007 and became a partner in 2014. He has more than twenty years of commercial litigation experience in state and federal courts, with a special focus on disputes arising among partners and members of limited liability companies, often involving real estate. He is also a seasoned appellate advocate, having argued more than a dozen appeals, including before New York’s Court of Appeals, the state’s highest court.

Elan advises clients across industries in high stakes, complex disputes involving partnerships, limited liability companies, business torts, breach of contract in all its manifestations, business divorces, and all aspects of real estate litigation.

Representative Matters:

  • Represent the developer of a supertall luxury building on Manhattan’s “billionaire’s row” in $200 million partnership dispute with investor. Obtained summary judgment dismissing developer’s principals from the case.
  • Represent the ground lessee and developer of a property in special development district in the West Chelsea neighborhood of Manhattan in dispute with Landlord. Secured a victory in New York’s Court of Appeals, which held (clarifying a previously unsettled issue) that our client’s prior efforts to enforce the lease following a partial breach did not preclude it from later terminating the lease based on a subsequent repudiation.
  • Represent licensor of audio brands in dispute with licensee. After obtaining dismissal on suit alleging fraud and breach of contract by licensee and defending that dismissal twice on appeal, obtained summary judgment in a countersuit by licensor, and multimillion dollar judgment, including award of attorneys’ fees in both actions.
  • Represented the managing member of joint venture that acquired and sought to develop the site of the former Domino Sugar refinery in Brooklyn, New York in dispute with investor attempting to thwart a sale to a third party. Defeated multiple applications for emergency relief and ultimately, dismissal of three separate actions brought by investor.
  • Represent New York church in dispute with real estate developer concerning the enforceability of a preliminary agreement to develop church’s property. Obtained summary judgment and defended result on appeal.
  • Represent purchaser of private jets in $150 million dispute with manufacturer concerning enforceability of letter of intent.
