Adrienne Koch Publishes Article in New York Law Journal Special Section Focused on Litigation
Partner Adrienne B. Koch recently published an article in the New York Law Journal for a special section on litigation. Her piece focuses on strategies for pre-answer motions to dismiss under CPLR 3211(a)(7) and CPLR 3211(a)(1). In particular, Adrienne looks at relevant case law regarding the use of evidence under these rules, and suggests that under recent trends CPLR 3211(a)(7) may actually provide a more flexible vehicle for the use of evidence than CPLR 3211(a)(1).
The issue is important for both plaintiffs and defendants as these rules frequently come into play during the early stages of litigation.
